I politely asked my former employer to change the name on my W2 so I could file my taxes. He flat out told me "Not a chance. You were *old name*  when you worked for *company name*. If your choices are causing you troubles - your problem not mine. I'd suggest filing two returns??"

... which is illegal.

I'm currently on wait with the IRS ;) I hope he enjoys his visit from them, and his $100 fine.

He sound like a complete ass, I hope the IRS give him hell.

was there any animosity when you left to explain this or is he just one of those intolerant idiots?

Unless your social security number changed you should be fine.

I understand you're supposed to file under the name on your Social Security card, and that name change requests need to be done before the issue of the W-2 form. Hugs, Devlyn

What a jerk!

I was lucky when I changed my name - I showed them the court order - they changed all my personnel records

You should be fine filing your return.  I was worried b/c I changed my name this year & I filed and had my tax return in five days

An employer needs to make the W-2 out to the name that the person worked there under.  If you didn't change names until after you left their employement, they have no option but to use the name they have on file (as far as I know).

If you got your court order while you were still working there, then they should change their records and file accordingly.

I didn't previously tell him, no. I just asked him today and that is what he said in return. But he is a bigot, so I don't mind seeing him squirm.

I told him I am working as a tax preparer and filing 2 separate returns is illegal (which it is).

He just got back with me saying "My response may have been hairsh - for that I apologize. However, I don't see where I need to spend time and resources to fix what I did correctly. I hope all is well with you and that you get this sorted out"

To which I said "I will gladly send you a few dollars for the trouble to avoid asking the IRS what I should do. If you would like any other proof to show I am not doing this for any nefarious reasons, I will gladly provide that. Thank you for the fair wishes and I hope the same for you and your family also."

Furthermore, I've been on the IRS.gov website. It specifically says the W2 information needs to match your current Social Security number. Like I said, I'm on hold with the IRS now, so we will see.

Lastly, their site says if they refuse to send the corrected W2, I need to call the IRS and they will send me a complaint form, which I need to send to them. Each form they have to investigate will be followed up by a $100 fine.

The first year of my name change, it wasn't an issue that there was a different first and middle name on my w2 than on my tax return. I had already changed the info with ss and it was the same number.

I'll ask the IRS when they answer the damn phone and my call doesn't drop... My phone drops calls all the time and their wait time is 30 minutes long...

The IRS said it's not an issue if I file electronically and substitute the old name for the new name on the W2 portion. Issue resolved... darnit. I wanted to annoy him :D

I'm really glad you found this out as the company I work for did not change my name on my W2, so it still has my old name. I'm glad to know it wont cause me any issues.
