Urgent need advice (German system)
« on: August 10, 2022, 07:22:03 am »
Hello folks,

I'm really desperate right now. I found out for myself that this is not the right path for me. Briefly about me, I went through the VPÄ  (Name and gender change) in 2020 (did not take any hormones).

I have never handed in or changed my passport or any other documents.
My question now is: is this still valid?

I will enter a country that has much stricter laws (you can probably guess - C). I have to get a visa now. Can I use my pass?

I desperately need your help!
Can I file an urgent application + legal aid? Would it be possible to go through this in a month - max 2? :(

-----

Hallo Leute,

Also what shall I do. In Germany it is really complex :(
I would need "Prozesskostenhilfe" which is finanical support which might take months and months. I would be unable to do my job :(.

Without financial support such name and gender change (to go back to it) will cost 10 000 Euros but it would be much faster than waiting for financiacal support (which is also not 100% guaranteed). I

I do not have the money as currently unemployed and no savings. :( I just don't know what to do. I think a goandfundme would not be appropriate and it would be really embarassing for me. I could just start crying (I am actually right now) because I might not be able to do this job. I only graduated two years ago and it is only my second job. :''''((((

Hi v_7

Maybe you would like to read in this thread, it is specific for Germans:  https://www.susans.org/forums/index.php/board,523.0.html

I also recommend that you inquire directly with the authorities in your place of residence, this is the only way to get the exact answers and information you really need.

Best wishes

Yes, i decided to go tmrw to the institution.

Does anybody in this forum know if when applying for a visa, the authorities of the country that you are going to are checking your birth certficiate or just the general data in the system?

Hi v_7

That's a good decision to get the information from the competent authority directly. Fist hand Information are always best.
An other possibility would be to contact the authority for whom the Visa will be.
It is always very important to handle all this this stuff the absolutely proper way, because this guys have really no sense of humor.

Best wishes

If I understand this righ. You have changed your identity to a female but on your passport that is valid today it still say you are a man?
I don't see any problem in this like you do. Just go and apply for a new passport. If you travel in a few days just loose your passport and apply for a temporary passport.
When you change your passport you take with you the paperwork from authority that say you have changed sex.

I have changed it to male and also the name. However, I will go to the authority tomorrow. The birth certificate authority and the passport one are separate. They might not have communicated.

Hi, isn't it a problem if I tell them I changed sex (which I actually did not).

I am going there for a work visa. And I gave the employer my birthname etc.

Wanted to highlight that everything went through court proceedings 2 yeara go. officially my passort is not valid but authorities do not communicate a lot. I assume that everything is still the same in the databank except with my brith cert.

Will ask tmrw. and keep you updated here. I can still use my passport though.

Your passport is valid until the date in the passport. If you travel in Europe no one will care. But if you travel to Arabic country I don't recommend you travel with a passport if you have changed name and gender sex and not have changed your passport. Many transgender have a lot of problems to get out from the country when they passing the immigration. For example Dubai. If they find out your name and gender sex isn't correct in the passport you will end up in jail for sure. Many Arabic country isn't transgender friendly.

For an example, do an internet search for 'Thai model denied entry'.

How should they find out? it is only on the birth cert. but authorities still have my female name saved and female name.

I think they only look at the passport information though.

I have applied for the process to reverse it but in Germany it take 6-9 months. I will be in that country in 4 months. I do not think they will find out when I enter  (still gotta apply for the visa. If my visa goes through I will be fine).

I just do not want to lose that job I ever wanted and country I always wanted to live in (it is not Arabic ;) but Asian).

Hi v_7
To be honest, I really really advise caution and not playing any kind of unforeseeable-dangerous-game with an unknown end!
Again, it is important to handle all that stuff the absolutely proper way. All your personal informations (inkl. employment contract) need to match perfectly, because this guys have really no sense of humor.
You are, I hope, are an sane adult human being so it is up to you to choose where your life should go...

Hi everybody,

thx for the many answers. I googled the "Thai model no entry". However, I have not medically transitioned and I look female just like in my passport + the authorities have my female data. It is only the birth cert. So my situation is a bit different.

:/ I will try to get the court case approved sooner and I hope it works.

And all my documets like degrees, certificates are also on my female name.
The issue is that the court for changing the birth certificate is sooo slow in Germany. :o
I just do not know how to convince them to do an "Eilantrag" (emergency appeal).

But I do not know how deep the immigration office will look at my personal data. Will it just be my passport, criminal convictions, emloyers, fincanial insitution I am registered at, health insurance, reference letters? All my data here is on female as I decided against changing it when I decided against transitioning. However, the court still changed the birth certificate which is the only thing "male".

I contacted the authorities and explained the situation to them. Have not received an answer yet but will update here.

Let say you travel to Bangkok. I been there so many time the only thing they look at is your pictures match you. And you say it does.  They check your visa if is valid and if you been there before. That's it. You apply the visa and if you have all the paperwork and your passport have a valid date so it shouldn't be any problems at all. The only problem is that you probably have to mark if you are female or a male to enter the country. If you lie you can be prosecuted. If your visa get approved you can go travel if you dare. When you arrive you can change your passport there. Before you leave you can apply for the other stuff so it maybe is ready while you are there to change the passport in your embassy.
If I was you, yes I don't hesitate to go. But you have to make your own decisions. Good luck.

thanks again. I checked with all the authorities and it is only on the birth cert. I will still go but try to make it reversible before. Hope the court is fast enough.
