Move to ban iPods from crossing the street

A single person was killed while listening to an iPod. maybe. Do we know it was definitely on and the level it was set at? Do iPods have a built in version of a black box for us to examine? Do they not have an off button? Where was the concern during the 80s when walkmans and boom boxes ruled the streets? Is it impossible to be run over while not listening to an iPod?
