Disclosure vs. Non-Disclosure: Us and Them?

http://blogs.montrealgazette.com/2012/03/25/disclosure-vs-non-disclosure-us-and-them/The kerfuffle over the Miss Universe Canada pageant and Jenna Talackova — who was reportedly asked to leave the pageant when it was revealed that she is not a "naturally born woman" — has raised questions once again about disclosure: when do we women who have transitioned have to disclose that fact?
Note that I am saying "have to disclose the fact." Not "should disclose the fact."
There is a difference. We've often talked here about disclosing our transitional past to potential love interests. Some people feel we should be upfront about it from the start, others feel we should wait for a while, and others think we should never tell. That's a personal decision.
But, when do we HAVE TO TELL private and public organizations? Do we have to tell a new employer? Do any of those organizations have the right to ask us? If they do ask us, are they discriminating against us?
