County denies liability in death


Mother of inmate files suit after son's death

Forrest County has answered a lawsuit filed against it in U.S. District Court by the mother of a suspect who died in custody last year at the Forrest County Jail.

The county, along with Sheriff Billy McGee, a jail nurse and corrections officer, admits that Devin Daniel Fortune died while incarcerated, but denies liability in his death.

Fortune, who was 29 at the time of his death, was jailed for allegedly stabbing his transsexual partner to death in Hattiesburg in 2009.

Fortune's mother alleges in the May lawsuit that her son complained of a sinus infection, fever, problems breathing and a sore throat on March 28, 2011, for which he was prescribed antibiotics and antihistamines for 10 days.

HATTIESBURG — A man arrested and charged in the slaying of a transsexual told reporters that he stabbed the victim after they had an argument.

Devin Fortune, 28, appeared in Forrest County Justice Court today for his role in the stabbing death of Archie Avis Brooks, 47.

"I feel bad," Fortune told reporters. "I regret what I done. I made a mistake."

Bond for Fortune, who is charged with one count of murder, was set at $1 million during his initial court appearance. Fortune is being held at the Forrest County Jail.

Fortune was arrested Monday in connection to the slaying of Brooks, who was born Karen Brooks, according to his mother.

Hattiesburg police have arrested the companion of a transsexual whose
body was found Sunday in a West Fourth Street apartment.

Devin Fortune, 28, was charged Monday with murder in the slaying of
Archie Avis Brooks, 47.

Brooks, who lived in the Oakwood Apartments second-floor unit, had
been dead since July 26, said Forrest County Deputy Coroner Jonathan
Nobles. He died of multiple stab wounds.

Fortune had gone missing at the time of Brooks's murder, according to neighbors.

28 year old Devin Fortune is charged with one count of murder in the stabbing death of 47 year old Archie Avis Brooks. He is being held at the Forrest County Jail on a $1 million bail.
