Name change information help please

I have been giving it a lot of thaught recently, when it comes time to change my name on all of my documents and identity papers how does that affect me and my children legaly , are they still connected to me on paper, can my x wife use the change as a way to gain full custody of them this has caused my quite a lot of anxiety.

At the moment when I take my daughter to an appointment I get asked if I am her dad what do I tell them after the document change because I am obviously not her mother but won't want to be outed by saying I'm her father and being dressed as a woman it could get quite confusing to others and embarrassing for me.

Also will I still have a legal right to see my other daughter or does a name and sex change on paper change all that. It does concern me quite a lot as I do care for my children a lot and wouldn't want to loose them over a simple name and sex change on paper.

Obviously genetically they are still mine but will they still legally be mine, can someone please help me out with my stressful problem.

In Australia you are fully protected by law. Your name change, gender change etc does not affect legal guardianship at all. That is not to say your wife may not use it in a divorce process or custody to get at you if that is what you fear. But I think legally that is dead in the ground.

The name change is very easy just go to google and look for Australian name change, it takes a few weeks to get the documents back.

Your therapist can give you the letters to change your gender on all legal documents including passport, medicare, ATO etc. The letter just says that Emily gender identity is female, she has had counselling and  her documentation should be rectified to correctly gender ID her, it is a  'form' letter.

Just remember to carry a  copy of your name change certificate for changing bank account name and that sort of thing, utilities want to see proof of name change they just need to sight it. I had a funny few moment trying to deposit an ATO refund into my account as it was made out to former name. Bank attendant was certain that I wasn't him and I agreed, but I used to be, we had a few good laughs about it.

The only sticking point is the marriage certificate. I'm female on every single legal document but since same sex marriage is illegal here I can't change that - Mmm High court challenge is just waiting for that one. It is just about country to the Federal Act passed in 2013 for not being able to change name and gender on the marriage certificate.

Thank you for clarifying that for me Cindy its a load off of my mind legally I am still married but separated from her the divorse should start in July next year so I should be able to change everything at once if I wait till then.

Thanks so much Cindy I have my first doctors appt at the obrian street practice for a referral to a gender specialised psyc to start my journey sooo excited.
