Hello :) ~ as you all know, i'm married; my wife presented me with a worry just now; she's afraid that our marriage will be invalidated the moment i change my gender marker (which will be happening in 4-8 weeks). I did a search on google and found that a case known as Roach v. Roach n.k.a Silverwolf that took place in Florida, where a transman tried to get out of paying alimony by claiming that Julia Roach (pre-transition persona) was "legally dead", but it was revoked as the marriage was already valid back then and remained valid even after transition... But I don't know how much of this is true or how old the case is and if things have changed for better or worse since that case.

So can anyone offer me any insight as to whether or not we should be worried about losing marital validity? Same sex marriage is still banned in Florida.

Any info would be greatly appreciated <3

Don't worry. Even though same sex marriage isn't allowed here (I'm in pensacola), your marriage will still be recognized, nothing will change. Your marriage can not be invalidated or annulled without one or both of you petitioning for it.

Wow, that seems kind of slimy....  maybe there was more to it than it looks on the surface...

But yeah, my understanding of it is that a marriage is still valid even after transition pretty much everywhere in the U.S.  At least that's what I've always been told.

My x-wife and I actually looked at this to avoid legal fees and court costs. We were told by by legal council that there has never been a precident for this. I couldn't find one online either.
