The 7th Circuit, which encompasses Indiana, ruled in 1984 that sex discrimination workplace protections do not protect transsexuals, so the company moved to dismiss the case. But Creed pointed to the 1989 US Supreme Court case, Price Waterhouse v. Hopkins, which ruled that sexual discrimination protections applied to a woman who was denied a partnership because some partners considered her to be inadequately feminine in appearance and behavior for their concept of a "lady partner."

Since then, several appeals courts have accepted the argument that a gay or transsexual employee disciplined or discharged for failing to comply with gender stereotypes enjoys similar protection.
