CA-USA Birth Certificate Amendment

CA-USA Birth Certificate Amendment HELP Plz...  :embarrassed:

I got my name and gender, changed in Court, got my new Social Security Card, Reflecting the changes.
i still had not gone to DMV, i have appointment in a few days.... hope it goes well without a Birth Certificate Update.

my question is this i am STUCK on the Birth Certificate Forms.

i requested VS-24 & VS-23 Forms, and there are 4x Pages for diffrent titles listed for what you want done

1. Amending A Birth Certificate After A Court Order Name Change
2. Obtaining A New Birth Certificate After GENDER REASSIGNMENT
3. Correcting Gender Errors on Birth Certificate
4. Affidavit To Amend A Birth Record

i have no idea if i have to FILL out all the forms or a few or 1 title...
i do not have the money to talk to lawyer as well as anyone that knows this & google is no help yikes i know

1. i have NOT had GENDER REASSIGNMENT
2. My Court Order is a NAME AND GENDER CHANGE & Signed and Stamped by court
3. Social Security Updated all info with new Name & Gender

CA COURTS WEB SITE STATES:
Important! You do not need a court ordered gender change to change your California driver's license, social security card, or U.S. passport. You also no longer need a court order to have a new birth certificate issued reflecting a change of gender (for California birth records).

There for i dont need GENDER REASSIGNMENT & i dont really need a court order even though i got one.

now the court KEPT my Original NC-210/NC-310 ( Declaration of Physician
is that going to be an issue do they need a Fresh non copy?

My Question is:
1. What VS-24 or VS-23 FOrm do i need to fill out & what do i need to send in with the $23 Money Order and Documents?... and what sample is best to base off...

Jeeze, they don't make it simple do they? I can't help you but I'll bump this back up and hopefully someone from CA can provide some advice.

I've seen those forms before, and here's a summary (I'm not a lawyer or official, so don't take my word for granted):

Form #3 would not apply to you (or most other transgender people) - that one is used when the sex designation was incorrectly entered at birth (not one that is changed due to gender reassignment later).

I'm not sure what the purpose of Form #4 is, but I believe it's for whenever a correction based on evidence that is not court-ordered is used to make a change. You probably won't have to use it, but I'm not sure.

Form #1 is for general legal name changes (non-marriage-related, of course) that aren't covered with another form. Since there is another form for transgender-related name changes you probably shouldn't use this one, except as described in the next paragraph. (Some important differences are that the original information won't appear when the gender reassignment form is used but in most cases they will when this form is used, and unlike Form #2 - and like most other birth certificate amendments - two signatures will be required to initiate the change.)

The form that most on here should use is the second one - the one specifically designated for gender reassignment. Whether or not you can use it without having GRS depends on what their current policy is (which I'm not sure of at this point). If you meet the requirements now, you can go ahead and get your new birth certificate. If you don't, but expect to in the future, then unless you need your BC amended now for some reason then wait until you meet the requirements for a full gender change. Only if you expect to live long-term without being able to fully change your gender should you go ahead and change your name with the first form (since the second one has special procedures in place different from those generally used in order to protect transgender people's privacy).

so dose that mean i should use "2. Obtaining A New Birth Certificate After GENDER REASSIGNMENT" even though i has not had Surgery BUT have it changed on paper through court

It appears that you need to use VS 24. 

You have undergone legal Gender Reassignment as far as the State of California is concerned.  Your doctor has to have given you a letter, that you submitted to the court, indicating that you have undergone appropriate treatment to change your gender.  The order you received from the court is the legal recognition of your change of gender.

The Transgender Law Center has a PDF publication entitled "ID Please" that provides all the instruction you will need to fill out the VS 24 form.

Attachment I is an overview of how to fill out VS 24. 

Remember, you need to fill out an original VS 24 in order to get your birth certificate changed.  They do not accept photocopies.  Additionally, you need to have an original certified copy of your court order.

Assuming you already have a drivers license and you are just changing your name and gender marker you do not need your birth certificate to accomplish the change.

FINGERS CROSS just Mail-ed off my Papers.......

1. Sent in $23 Money Order (DONE)
2. sent in a copy of my birth certificate (DONE)
3. sent in Court Order with stamp (DONE)
4. sent in VS24 form on special paper i order from them (DONE)
5. sent in blood sample ( Failed )
6. sent in photo of my Genitals ( EPIC FAIL )
7. sent in all papers & items requiered ( ok )

NOW I SHALL WAIT........... ill post update if i get a FAIL or PASS update later

Well did it i got my NEW CA-US BIRTH CERTIFICATE, in The Mail Tills me Name Name and Sex is Female.

so i got my new Social Security Card, GOt my new DMV Card with sex female & now this.

everything seems to be complete!
