A federal appeals court in Chicago ruled Tuesday that a 1964 law barring sex discrimination extends to sexual orientation, marking a major workplace victory for gays and lesbians.

Ruling also specifically protects transexuals:

"The discriminatory behavior does not exist without taking the victim's biological sex (either as observed at birth or as modified, in the case of transsexuals) into account. Any discomfort, disapproval, or job decision based on the fact that the complainant — woman or man — dresses differently, speaks differently, or dates or marries a same-sex partner, is a reaction purely and simply based on sex."

It'll take another case to get this to stick for all transgender folks. The parenthetical aside you not may not be seen as a binding element of the decision, although itvcould influence another case
