A legal challenge over whether trans women can be regarded as female for the purposes of the 2010 Equality Act begins at the UK Supreme Court on Tuesday.

The action is the latest in a series of challenges brought by the campaign group For Women Scotland (FWS) over the definition of "woman" in Scottish legislation mandating 50% female representation on public boards.

The case centres on whether or not somebody with a gender recognition certificate (GRC) recognising their gender as female should be treated as a woman under the 2010 Equality Act.

The Gender Representation on Public Boards (Scotland) Act 2018 is a piece of legislation intended to increase the proportion of women on public boards in Scotland.

Following the challenge, the Scottish Government dropped the definition from the act and issued revised statutory guidance – essentially, advice on how to comply with the law.

This stated that under the 2018 Act the definition of a woman was the same as that set out in the Equality Act 2010, and also that a person with a GRC recognising their gender as female had the sex of a woman.

FWS challenged this revised guidance on the grounds sex under the Equality Act referred to its biological meaning and said the Government was overstepping its powers by effectively redefining the meaning of "woman".

Geez, you scared me with the "(Ireland)" in the subject line!  It is a British (United Kingdom) story.  The only connection to Ireland seems to be that the linked story appears on an Irish news site.

Ireland is my bail-out option if Canada goes full-on Trumpist in the next election.  So the headline sure rang my alarm bells!  If Ireland becomes unsafe, then I am up the creek.  Fortunately, it appears not to be so, at least for now.

This is seriously a 'non-news story'..

The Equality Act prohibits discrimination based on an individual's sexual orientation or gender identity in employment, housing, credit, education, jury service, federally-funded programs (including health care), and businesses that serve the public.

Some very small TERF like organisation is dredging up a nearly 7 year old piece of legislation to try and make a few headlines for themselves to get people to pay to join their evil little club.. free advertising from MSN for the cost of a court case.. It will, of course, be thrown out before it even gets to a 'proper' hearing because it would take a whole lot more legal muscle to overthrow the entirety of the Equality Act 2010... Its already been thrown out of 2 courts but they were allowed to take it to another appeal. To them it is just a waste of money to try and get more column inches.. it's a shame that this lesbian group decide to waste such huge resources on this hate rather than directing those funds to actually help women in their communities.. shame, shame and more shame on them, for they are a disgrace.
