Trans Rights Breached Following Supreme Court Ruling

The government's treatment of trans people in the UK could breach their human rights, a top European equality official has said.

The Supreme Court ruled in April that the word 'woman' refers to biological sex under anti-discrimination law, in a blow to trans rights.

Judges stressed that the ruling was not a comment on whether trans women are women and that it would not change their legal rights.

Britain's equality watchdog, the EHRC, has issued guidance following the ruling that recommends single-sex service providers – think public bathrooms or changing rooms – ban trans women altogether.

Michael O'Flaherty, the human rights commissioner at the Council of Europe, has told the government his concerns about the decision after visiting the UK to observe human rights.

He wrote to Home Secretary Shabana Mahmood and MPs that he observed how discussions about trans women have 'tended towards' their exclusion, which would go against the European Convention on Human Rights.

'It would therefore be crucial for all stakeholders to receive clear guidance on how inclusion of trans people can be achieved across all areas, and how exclusion can be minimised to situations in which this would be strictly necessary and proportionate, in line with well-established human rights principles,' he wrote.

O'Flaherty warned that trans people must not be forced to obtain a gender recognition act – a document that allows a person to change the gender marker on their birth certificate.

It's all too sad to believe but the reaction here in the UK (in the political commentary sphere) has not been to reopen the debate and ask questions of the original report's conclusions.

The response has been to ask if we should leave the European Convention on Human Rights act! Human rights are being eroded, opportunist politicians and media commentators latched onto this and called it an overreach by Europe.

The call to action here is surely one of reopening the discussion, looking back at the Australian report which debunked the original report and resetting the narrative.

They will not realize the absurdity of this until they ensure that the requirements apply equally to everyone. Make everyone go through the same process and obtain a gender recognition certificate. When the majority (cisgender) are forced to go jump through the same administrative hoops, pay the same fees, and delay portions of their lives while waiting, then they will begin to realize how unnecessary it all is.

There will always be abuse of a system. When I went to court to legally change my name, I had to sign a document swearing that my name change was not for illegal purposes (dodge taxes or child support, etc.). If someone were to change their name or gender through a legal process for nefarious reasons, there is a criminal penalty to pay. In the meantime, assume everyone is innocent until proven guilty. Just change the document.
