Transsexual Can Sue Library of Congress


I heard about this case on the radio the other night. Seems like a clear case of discrimination to me. Who cares if this guy is now a gal? Can this person do the job? That's all that should matter.

a.  Such a post would require security clearance.  Such information is 'of national security interest' and (in time of 'war') not subject to court orders. The reason she was not hired may, or may not, be TS related.  Either way, its not like you are going to ever find out.  I hate Homeland Security.  So where were all of you when the Fourth Reich passed these laws in the first place?

b.  Rodger's Park is a neighborhood in Chicago.  How come no other coverage?

Ummm, the attempt to sue has been ongoing for a long while now. The security issue is a no-go here as she was previously employed in an anti-terrorist element of the military. If she can pass that vetting i would imagine that she'll see nothing at the LOC that is any more sensitive than what she saw on a daily basis in the military doing basically the same job.

She was offered the job and was told that 'she was just what they were looking for' or some such thing.

I'm glad the court is letting her suit progress. This one seems pretty obvious that it is solely due to her gender, or, what they may view as 'the changing of her gender.'

A number of cases have been brought using Title VII and this one may not progress as many of us would like. But, the more theories that are tested and the more defined rulings courts make on Title VII the better chance we are gonna eventually get a winner.

I recall this mess from some months ago.  The Library of Congress had found her to be a totally qualified candidate, made her an offer, then withdrew the offer when they learned that she was TS.

I have worked in jobs that required a security clearance and I never failed to get and maintain one.  I outed myself to the inspector from  the Office of Personnel  Management and my clearance remained in-place, even after I had changed my name.

The Library of Congress was wrong and if this woman has standing to sue, I hope that she gets to own their building because she was trusted and qualified, had a written, bona fide offer, only to be screwed-over by transphobia.
