QuoteDear Susan,

this is a first stage kind request to please remove all refrances to myself from your site as it is searchable and has outed me at work. i am unable to take this down myself so therefore please can you asn the owner of the site take this down. it contains info that is personal such as my name and email addresses.

you have 7 days to comply failure to do so may result in other action, i would rather settle this amicably.

Here is my response...

QuotePlease see the TOS specifically

Quote6. You should not give out personal information which may lead to your being identified, or contacted in person, by email or other means. If you chose to do so, then you also accept the accompanying risks. Aliases and the use of alternate email addresses are encouraged.

and

Quote18. By submitting any information to this internet site you hereby grant a irrevocable license to use the information of which you are the owner to the owner of this internet site, and to other individuals which are designated by the site owners.

This includes but is not limited to your profile information, contributed photographs, forum posts and messages, wiki articles, email messages which are sent by you to the site staff or owner and their responses, and any other materials submitted by you to this website but which are not specified here.

This license is understood to include the rights of use to all intellectual property rights owned by you to the material in question, including but not limited to trademarks, copyrights, trade secrets, and so on.

These granted rights may be exercised, or terminated and the material removed; at the sole discretion of the website's owner at any time, without further notification of these actions being required. Any materials which are used under this granted license will contain proper attribution as to it's source.

These were in force when you voluntarily submitted information to this web site. So you waived any and all claims by your initial submission of the materials in question.

Let me be blunt, I do not react well to threats. Think about it for 7 days, and then on the eight day you can send me an apology for threatening me, along with a polite non-threatening request, and I will consider removing the information in question. But if you attempt any kind of legal action expect a prompt motion for dismissal, and counter suit with a claim for damages, and all associated attorney fees.

Why couldn't she have just been polite about it? Talk about rude.

I see no threat except in partial, your response. But I think and process logistically instead of "Lololol go you for out-of-your-way aggrivated response lolol hooray" hivemind thinking.

Is there an account here that they're referring to? If so, it's extremely simple to click a few buttons on an SMF board and remove said account and all posts. Once removed, the cached data will die out of Google quickly.

But people really do need to read TOS's more often. Would save everyone trouble.

Lame.

They don't read the TOS on my board either, and then get mad when I get a bit testy about it.
  •

spacial

Think this is the threat element.

Quoteyou have 7 days to comply failure to do so may result in other action,

What I can't understand is why this person can't remove the stuff themself?

Possibly a bit of attention seeking? :police:

If they started the thread or someone replied to a post with a quote, then they can't remove it.  They could modify their own posts, but not those of others.

"Ya pays your money, ya takes your chances."

It is the internet.  You really can't hide, just cover your tracks.  And if she was out, why not run with it.

I talked with Sarae yesterday in Chat, she made the same threat there and I responded that there was no action she could take since she was the one who had made the post herself (in the links).

I told her that IRCOPS could not make the change she was requesting and that she should email you.

I also asked Janet if she could remove the offending link and Janet immediately did so.

p.s. (side note), Sarae had made this request once before around 6 months or a year ago.

If you are being 'outed' by being on the board, why come back and post more?  And it's not the board, it's a self made deal.

It kind of reminds me of the True Grit dialog.

Mattie Ross: They're in this story together. Now, I've got business across the river and if you interfere with me you may land up in court which you don't want to be. I've got a good lawyer in J. Noble Daggett.

Rooster Cogburn: [to LaBoeuf] Lawyer Daggett again.

LaBoeuf: She draws him like a gun.

She opened her request by threatening legal action if i didn't accede to her demands. I  will dig in my heels at threats like that. But a polite message saying that hey I posted this, and it is causing me problems could you please remove it, would have yielded instant results.

Always make sure you specify specific urls to the content in question, I am not going to go and search every single page on this site for your name and remove it for you...

As I pointed out to here the use of aliases and alternate emails is encouraged when submitting content to this site for this specific reason. If she had followed my recommendation she would have never been outed in the first place.

I fail to see any liability unless you held a gun to their head and forced them to post.  Even then, it's easy enough to call up your posts and delete them.  Empty threats rarely work.  People who really can do something, never have to threaten to do it.

I think she needs a few lessons on how to win friends and influence people.

Well if just outed then she is feeling pretty vulnerable, threatened, scared, and outraged. I get that and we do not usually make the best decisions during times that cause the above. However, anyone who has spent any amount of time here knows that a very respectful e-mail goes miles and miles with Susan and the staff.

If I wasn't already out and someone came here and discovered I was a member, the first thing I'd ask them is "What were you doing on a transgender board?"  It's not like this site pops up on a Google search for kitchen utensils.  People that come here usually are looking for it.
When you judge others, you do not define them, you define yourself.
  •

Janet_Girl

I have even Googled my name and my *malename* and nothing comes up.  Someone had to purposely came here looking for her.
  •

YellowDaisy

if anything, this should be a good lesson for her not to give out personal information on the internet. unless they searched her male name, and she was tagged in a result on this website? i don't know how that works, but it should be common knowledge not to put your life story on an internet site that is open to the public.

<shakes head in disbelief at the social ineptitude of some people>

Well done Susan for standing up to a potential bully!

Legal threats are never a good opening move, particularly when, as it turns out, she evidently didn't bother to read the TOS before posting. Besides this is the internet age. A good well trained researcher like me can usually find out most things about most people if they have a mind to do so. So the easiest thing is to get used it, and stop worrying about who knows what.
