The same way a Black, a Jew, a Gay, a Woman...any group considered a minority....can tell.
If you're being discriminated against because of who you are...the signs can range from the very subtle looks and hushed whispers...to completely overt comments and actions.

Unless someone is fairly overt though, it can sometimes be difficult to tell...and therfore difficult to prove or prosecute...even with protections in place. But such is life. Better to have protections in place, and have a chance at fariness and equality, than to let such foul behaviour be tacitly condoned by our own government.
