El Paso County has asked Attorney General Greg Abbott for advice on how to distinguish men from women, and the answer could play a role in the divisive debate over same-sex marriage.

The county's problems began in February when Sabrina Jeanne Hill requested a license to marry another woman. The answer is usually a no-brainer in Texas, where same-sex marriage is banned by state law and a voter-approved constitutional amendment.

But Hill, formerly named Virgil Eugene Hill, submitted a birth certificate indicating she was born male. Hill also provided an Arizona driver's license listing her sex as female and a court order acknowledging that her name had changed after she underwent surgery to become a woman.
