Sexually reassigned, inmate's alone among 96 males

Even though her birth certificate and driver's license list Deena Kaye Myers as a female, she has been assigned to serve her sentence in an all-male facility.

CAPRON—Deena Kaye Myers entered the world on Christmas Eve 1981 with a birth defect so severe that males with the condition were often surgically altered to females.

The newborn male was rushed from Danville Memorial Hospital to Duke University Medical Center for a series of neonatal operations. On Feb. 18, 1982, a Virginia birth certificate was filed recording Myers' sex as female.

Like others sexually reassigned at birth, Myers later had trouble with gender identity. She also had trouble with the law and is serving a 15-year sentence, for 11 felony convictions, in a dormitory with 96 male inmates.

I don't condone her felonious activities, but the authorities seem completely ignorant of IS conditions and treating her properly. They seem to be insisting she is male, even to the point of trying to mandate testosterone shots. Scary stuff to be IS or trans and incarcerated.

In some areas IS have less rights than TS. Ironic.

Now we have learned that Virginia does NOT recognize surgical sex change in cases of placement to prison.  We have also evidence that some states have done it. 
The general norm is: '' Juridistications let genitals control prison placement UNLESS empiristic evidence or written materials from the juridistication suggest otherwise.'' Virginia is an example from different policy.

For example in the Europe Finland has same kind of policy. Despite of legal and surgical sex change the prison system uses so called ''passive data'' to determine the gender. Many other countries in the Europe house and Western world  transsexuals after surgical sex-change (vaginoplasty) to female prisons.

I see this women's situation being contradictory for many  laws indirectly and the constitution that I see strongly this case for needed to be litigated.

From constitution equal protection and artickles against cruel and unsual punishment. Gender motivated violance act. Prison rape elimination act. According to the U.S. law the prison is responsible for secure conditions of inmates. Putting anyone with vagina with males is a quit clear violation of the principals above. Very few juridistications state accepping such a policy. This case should go to federal court.
