Childs birth cert

Could after I get all my legal paperwork changed to male I be listed as the father on my sons birth cert? If not how does that work proving I'm his parent?

If the issue comes up, they can run a paternity test.  I doubt you could be listed as the father, but you could possible have your name changed on the b/c.

Not likely as they will always put your name at birth on the cert of your child.

Do you mean at the time of the birth of the child, or the parent's birth name? If it's the latter, that implies that (for example) an adopted child whose name was legally changed and who later has a child would put his/her pre-adoption name down (which doesn't make sense).

You can get your name changed on the birth cert with just your name change court order, but as for mother/father switching, I'm not sure.  If you're the only parent listed, I don't see why it would be a problem, but you know how weird the government can be ;)  The best way to find out is to call the Vital Records in your child's birth state.

More than likely you can get your position changed, but you may need to go to court a second time (and you would need an attorney for this).  If you ever do a step-parent/second-parent adoption, you can dictate who goes where on the new birth certificate.

It should go without saying that if there is a second parent listed on the certificate (living or dead), that you probably cannot change your position.  Take heart that many same-sex parents get stuck being listed with the wrong title too.  People don't pay attention to that part anyway, and they'd probably just assume it was a mess up on the part of the file clerks if they did notice it.

Also, don't forget that you will need to change your name with Social Security for your child's record as well.  Good luck!  =)

I've had difficulty with this from the other side -- I'm MtF and have difficulties with convincing people I'm her father.  Two things have helped:
1) My daughter has become very good at diffusing the situations by explaining the situation herself.  The child asserting you are the parent works wonders.
2) Carry your child's birth certificate and what ever paper trail you need to link yourself... ie if you changed names but haven't updated it on the BC, then carry name change papers as well.
