Transgender widow case boils down to gay marriage ban

The big headline-grabbing story is the legal battle between transgender widow Nikki Araguz and her late firefighter husband's family over survivor benefits. The husband's family is claiming that their marriage was illegal from the get-go because they were both males. Thus, the basis of this exotic and titillating story really comes down to Texas' ban on gay marriage.

There is a simple solution to these kinds of issues that satisfies everyone: let's get the State of Texas out of the marriage business.

Nikki has indicated clearly in an interview she hates being referred to as "transgender" and that she views this as simply a case of recognition of her womanhood.  It has absolutely nothing to do with gay anything, that is just yet another appropriation of the lives of women of history, particularly heterosexual ones (and before you jump my ass, I'm bisexual myself) by gays.

The Woman had a Gender REASSIGNMENT Surgery. GAY BAN's HAVE NOTHING TO DO WITH THIS!!!

In addition, I've read more than one report suggesting that she might actually be intersex, thus she isn't trans-anything.
