Marriage?

I have a little bit of a problem.. I was born in Texas so i guess its pretty damn hard to change your sex on your birth certificate.. if anyone in here from texas has done it.. what are some tips? but other then that.. i am now living back in Tx and in order to change my sex on my id i have to have a sex change court document and in order to get that they say that i need a surgery which i dont have any. but i had lived in Oregon the past 2 years and i know there i can get my gender marker changed on my ID so once i get that changed can i get married as a guy or do i have to wait for my birth certificate to be changed aswell. i know in most court houses all you need is your social, and a state id to get married. need to know cuz my wedding date is July 23rd.

There was a news story recently where a transman married his girlfriend.  Only to have his marriage licenses revoked a few hours later.  Unless there is an M on the birth certificate it just wasn't going to happen for him.     

I looked for the story but I couldn't find it.  I'm not sure what state that happened in but it is something to keep in mind.

Texas is a bad state to live in as transgender.  It was the state we always studied in school as having the worse outcomes for transgender folks.  My suggestion is to move to a different state.

Texas Birth Certificate Law: Gender Identity Issues
Texas permits a post-operative transsexual to amend his or her birth records after obtaining a court order indicating that his or her sex has been changed by surgical procedure and a court order indicating a name change.

Some officials appear to be refusing to follow this policy based on a mistaken belief that the 1999 Littleton v. Prange decision prohibits them from doing so.

Citations: TEX. [HEALTH & SAFETY] CODE ANN. ยง 191.028; Littleton v. Prange, 9 S.W.3d 223 (Tex. Civ. App., 1999).

The Littleton case is where an mtf born in a different state and had her birth certificate and everything changed before moving to Texas married a Texas man who later died.  The court ruled b/c she was born a male that the marriage was not a valid marriage and she lost everything - no inhertiance rights.

dude I feel your pain! I was born in Texas too... haven't lived there in 18 years and they still make my life a living hell when it comes to trans laws.

Anyway... The only way to find out if you need your birth certificate to get a marriage license in your state is to call your local city clerks office to find out what your states individual law is... everywhere is different.

When it comes to changing your birth certificate... Texas will  only give you a REVISED version of your birth certificate for you which just gives you an additional paper that says you are male now but you were once a female.
Because of this some states WILL NOT grant you a marriage certificate. They will see that you are trans and have changed your gender and deny it. Seriously messed up I know but it's happened (I'm in the wedding industry so I've witnessed these stories first hand). I would ask the clerks office about this when you call to see were they stand on this issue...

Anyway, you don't always need surgery to get your BC changed. Some endocrinologist's will write THE LETTER for you instead. Anyone I know who has changed their gender marker has done it this way and they've never had a problem with it... so talk to your doctor about that option and if they would be willing to do that.

If all else fails there is always domestic partnership/civil unions... I know its not as awesome as actually marriage, but if your state allows it, than its the next best thing.

Not sure about Texas but I know that you run the risk of your social security card holding you up or having your license revoked in the end. You can change your name on your social but in order to change the registered sex on you SS card you have to have your birth certificate changed. Might want to do some more research on that one. The date is coming up fast. Best of luck brother.

also worth checking into: not sure if you are wanting surgery or not but i saw on a previous reply that texas will amend a birth certificate with a doctors letter stating you had SRS, i know that most docs who do top surgery give you a letter that simply says they performed SRS and you are now male according to the medical profession.
