WHARTON - A judge questioned lawyers today in a hearing to determine whether the marriage between a Wharton fire captain killed in the line of duty and his transgender wife was legal.

State District Judge Randy Clapp is hearing arguments from lawyers representing family members of Thomas Trevino Araguz III and his widow, Nikki Araguz, a transgender who was born male.

At issue is whether Nikki Araguz was male when she married Thomas Araguz in August 2008.
