Title: Game changer for TransAmerica
Post by: peky on April 25, 2012, 10:11:59 AM
The U.S.  Equal Employment Opportunity Commission has ruled that: " ..discrimination based on gender identity, change of sex, and/or transgender status is cognizable under "The Civil Rights Act of 1964 (Title VII) 42 USC 2000e et. sq..."

This maker ENDA almost a moot point, and it id in my opinion a game changer  ruling for TransAmerica.

We should celebrate !!! Champagne anybody ?

Yes it is a huge win.  NO it is not ENDA.  Until the other letters have protection we aren't protected.

Even with this I could still be fired for being a lesbian.

And before someone says well what about straight transpeople.  What is to keep the employer from saying you are still the old sex and therefore homosexual.

It applies to federal employees. States still have jurisdiction over whether or not to fire trans employees. Here in New York State that is the situation.

This is awesome news!!! And while this may be "just for federal employees" they are stating that discrimination based on sex applies to trans people. If others continue to discriminate in this way, there is now case law that supports the claim in court and they will likely lose. It won't take many law suits before this BS ends..

I did some digging on who get cover by this ruling, and it covers -in addition to federal, state, and local governments-  anybody who is employed by any company with 15 or more employees (this includes religious organizations, charitable organizations, and other nonprofitable organizations. IT does not cover the military.

So, yeah, this is a huge deal.
