Title: Implications of the Kolisek case for veterans
Post by: CindyLouCovington on September 26, 2012, 05:57:18 PM
This issue will end up being decided by the US Supreme Court regardless of whether Massachusetts decides to appeal.Trans prisoners all over the country will be suing for the same thing, and some state (certainly a Southern state) will definitely appeal all the way up there. And if it is sustained, it will be mean that not only convicts but ANYONE who is entitled to medical care provided by the Government will be eligible. For instance, VETERANS. After all, a state can only be required to provide NECESSARY medical care for convicts. And if it is necessary for them, it is necessary for everyone who is trans. And veterans are entitled to free medical care from the Federal Government. They are entitled to all NECESSARY medical procedures. There is no way that you can argue that what is necessary for trans convicts is not necessary for trans veterans, and since both are equally entitled to medical care at government expense,BOTH are equally eligible for SRS at government expense. It will probably take more law suits, but there is no way the government can avoid doing right by veterans.

Your probably right it will go to the highest court.

As a Veteran that case would be interesting.
