On Tuesday, plaintiffs in the case seeking to overturn President Donald Trump's ban on trans military servicemembers scored a major victory, with a ruling transforming the case, Talbott v USA, into a class action lawsuit.

The ruling for class certification allows plaintiffs to seek to extend protections won in Talbott v Trump to all transgender service members currently serving. It also ensures that future rulings against the ban will apply to all members of the newly created class.

A ruling on June 1 by the U.S. Court of Appeals for the District of Columbia upheld a district court's preliminary injunction halting military separation from the Trump v Talbott plaintiffs. Tuesday's decision allows attorneys in the case to seek its application to all transgender service members currently serving.

"There will be more process in court," said Michael Haley, a staff attorney for GLAD Law, which, along with the National Center for LGBTQ Rights, represents the original plaintiffs. "I don't want anybody to necessarily be under the impression that a win today means that things on the ground change immediately," he told Military.com on Tuesday morning, in anticipation of the ruling.

While application of previous wins for the original plaintiffs to the entire class of transgender service members will likely be challenged by the Trump administration, one thing is clear: "Any wins in this court will apply broadly" now to all current and aspiring trans service members, Haley said.
