School district sues Trump admin over pressure to discriminate against trans kids: "Not an option"

A Colorado school district is suing the Trump administration over pressure to rescind its trans-inclusive policies.

The administration threatened to withhold federal funding for Jeffco Public Schools if it continued to support trans students. In response, the district announced Tuesday it has filed a lawsuit against Secretary of Education Linda McMahon, noting that complying with the Education Department's (ED) threats would violate state law.

"Jeffco has been informed by the [U.S. Department of Education's Office of Civil Rights (OCR)] that continuing to follow Colorado law could place more than $50 million in annual federal funding at risk," Jeffco Public Schools' Interim Superintendent, Dr. Rob Stein, said in a statement. "At the same time, it is not an option for the district to knowingly violate state law. This has placed the district in an impossible position."

Earlier this year, the ED began an investigation after Jeffco Kids First, an anti-LGBTQ+ parents' rights group, reported the 75,000-student district. In its report, the group claimed that the district is discriminating against cis female students by allowing trans girls to access female-only facilitates and play in girls sports.

After several months of back and forth, the ED sent a letter to Jeffco (as well as sharing it publicly) saying that they had reached an impasse. That letter was followed by a letter of impending enforcement action, providing a final threat to federal funding for the school.
