The Oklahoma Supreme Court ruled last week that the state cannot update birth certificate gender markers and also said it has never legally been able to do so. While the case arose out of an attempt to restrict trans people's access to accurate documentation, the court ruled that the law also bars cis people from correcting the gender identity on their birth certificate even in the case of a clerical error.

This ruling means the law also blocks change requests from cis people who have had their gender incorrectly entered through a clerical error, and also from intersex people who are not identified until after their first year of life.

The Oklahoma Supreme Court's ruling does not end the case, though, as the judges were simply answering legal questions about what the law already states for the benefit of the appeals court. The case will now return to the Tenth Circuit for a decision on whether these rules and Stitt's executive order violate the plaintiffs' First Amendment rights.
