Many human beings who are seeking a marital relationship are looking for a partner with whom to share life's burden and bounty. And we as society have decided to provide a legal recognition to pairs of persons who have decided to engage in such a relationship. Not all marriages produce children, and no state's laws require that any married couple procreate. So the state apparently does not have any particular interest in the feasibility of procreation. If the state did have such an interest, then any person who is infertile for one reason or another would not be able to obtain a legal recognition for her relationship.

Here is a very good reason to remain in stealth after transition. I'd hate to think that my marriage status would be nullified if my husband were to pass on.
Someday.... and I hope to see it before I die, our society will accept us and our LGB friends as human with the same rights they enjoy.
