The Obama administration
has intervened on behalf of an openly homosexual teenager in a bullying lawsuit against his high school – and the Justice Department is claiming a law meant to ban sex discrimination also protects homosexual students from intolerance based on sexual orientation.
Jacob, 14, former student of Gregory B. Jarvis Junior/Senior High School in the Mohawk Central School District in New York, claims he was teased and endured threats and name-calling by classmates because he dyed his hair blue and pink and wears make-up and nail polish. According to the Justice Department's Jan. 14 motion to intervene, Jacob "engages in physical expressions that are stereotypically female, e.g., swinging his hips and singing in a high pitched voice."

While it may be quite unnecessary and even counter-productive for the executive branch to be stepping into a lawsuit, the lawsuit itself sounds warranted. Even if it isn't "protected discrimination" bullying shouldn't be tolerated. I understand that no school is going to be perfect but at the same time most Americans from coast to coast know how terrible discipline in schools is regardless of high school. It is a catch-22 that is getting worse. Public schools are funded by tax dollars, children are required to go up to a certain age, and at the same time teachers and administrators are afraid to control the children. They are so afraid of lawsuits themselves if they discipline the kids and if not that their own safety is often in danger by the very kids they are supposed to teach. Yet at the same time schools are clearly liable for what goes on in their buildings.
Apparently, it is difficult to get expelled from public school because after all the child is required to attend so how on earth can they be expelled? This is why I think there should be more privatization of education driven by market forces. Companies are already much faster at transgender acceptance than the government is because they want business which requires a maximum amount of paying customers and good publicity. You simply don't get that with government. If there was more competition in education beyond only the ONE school in the district or locale that children can attend, then bullying and threats and other disruptive behavior could be handled very promptly. Expel all of the brats and then the kids who actually want to learn can learn for a change. If they would stop being so politically correct and get rid of all of the troublemakers, the quality of the education would improve. When a child can't learn because he or she is constantly under fear of threats and violence, something seriously is wrong here and I certainly support such lawsuits as the kid and his family deserves every tax dollar they paid back from such a horrible excuse for an "institution of learning."

The variable in the sentence was "stepping into," not "executive branch." The problem was not with her statement, but your pecuiliar way of parsing it.
