Capone's warned by licensing board

On Monday night the Peabody Licensing Board issued Capone's Italian American Restaurant a warning for a complaint of discrimination from a transgender group alleging they were barred from entering the establishment based on their gender.

After weighing the testimony from both sides, the Licensing Board decided to give Capone's a warning.

"On the basis of the evidence presented at this hearing . . . we are unable to determine if the actual action was made with a discriminatory motive," read Chairman Minas J. Dakos. "However, we feel that this incident could have been avoided if management of Capone's had clearly outlined the reasons for denial of entry to the complainant either the night of the incident or the following day when they were contacted."
