Vandy Beth Glenn, a transsexual Georgia resident who won a legal victory last year after having been dismissed from employment as a legislative editor for the Georgia Assembly, expressed optimism after the 11th Circuit Court of Appeals heard testimony today in the state's appeal of that decision. "I felt like it went really well," said Glenn,. "I can't imagine it going better. It took a long time to get here, and I'm feeling good."
The argument seemed to turn largely on the pre-trial depositions of Brumby in which he said, among other things "It's unsettling to think of someone dressed in women's clothing with male sexual organs inside that clothing, It's "unnatural." The judges noted that a U. S. Supreme Court decision handed down in 1989 held that illegal discrimination against a person based on their sex was also evident when the discrimination occurred because the person did not conform to the stereotypical expectations associated with their biological sex. Judge Pryor indicated that in his view there was direct evidence of exactly that sort of discrimination in Glenn's case.
