The director of the Public Registry had argued that the change in the birth certificate following the operation by which Cassar had changed sex was only done to avoid embarrassment to the person concerned and this did not give right to the person to get married as Cassar had been born a man and not a woman. The director said that the operation was cosmetic in kind and that Cassar was still a man.
