Not sure if this is the right spot, so if it is not could someone correct the matter for me thanks. Anyway just came across this news article:

Indian police have charged a gold medal-winning athlete with raping her former partner after medical tests showed she was actually a man.

Pinki Pramanik, who retired in 2007 after winning team gold in the 4x400m relay at the 2006 Asian Games, was charged after a report was completed by a medical board set up to determine her gender.

"Medical tests have confirmed that Pinki is not a female," B.N. Kahali, chairman of the board, said.

"Pinki is a male pseudo-hermaphrodite. We have submitted the medical report to the district sessions court."

Rape is rape.

Both men and women can rape.

Don't see the point in forcing her to undergo these tests.

It depends on the circumstances...if the victim (assuming victim was a she, although both men and women can be victims) says she was raped by a man--i.e., by someone with a penis--and had semen for evidence, and says, "Pinki did it!"...but Pinki tells the police, "I couldn't have--I'm a woman, don't have a penis nor do I have semen", the police must confirm or deny one of the versions.

The victim's word is enough to start with, but Pinki's assertion can be medically verified (or denied) using a standard medical examination (in the US, that would have to be court-ordered).

The real story (and one that hurts us) is that Pinki was presenting as a woman, yet was able to rape.

Since this is mostly speculation and will probably remain so, I will offer an alternative explaination.

Male pseudo-hermaphrodites are genetic males who develop some female physical characteristics and identities.

Since she was a Gold Medal winner in international games, it seems unlikely she had male genitals, at least, exterior.

Portraying her as some sort of predatory male, pretending to be female, then publicising her medical condiion is disgusting and disgraceful.

I was bothered by the comment "The real story (and one that hurts us) is that Pinki was presenting as a woman, yet was able to rape."

Cisgender women can rape. Cismen can rape. Trans individuals can rape. Just because she could rape does not mean that she should not present as a woman. No one should be forced to present as any gender based on the assumptions of others.

I was too. I just didn't follow the logic for the same reasons you gave, Andrew.

I've checked out this on Wikipedia. There is an entry saying this.

I read the whole thing as someone trying to make an issue where there isn't one. Pramanik herself says the woman who reported her was blackmailing her.
