About a month ago, I got my name legally changed (woohoo!) and was going around getting new versions of all my important documents. The weirdest thing happened though- I haven't gotten a court order to change my gender marker yet (that was up next, I was getting a letter from my endo), but when I went in to get a new birth certificate, they kinda just... did it? Like, I didn't realize until I got home and saw the little "M" there. I know I need to go back and get it changed since I never got a legal order to get it changed and I'm walking around with a driver's license that still has me as an "F" (ugh), but I was wondering if this is something that happens on a regular basis or if it was just a thing that happened to me? What do I do about it even?
In my state, a person has to ask that the birth marker be changed on the birth certificate when they get their name changed. I can imagine that some judge might do it without being asked...

Honestly, I probably wouldn't do anything but enjoy not having the hassle of changing it later. Trying to "fix" it might be a real headache that would create more problems than it solves. And having the right marker on your BC means you can change other docs more easily.
Unless, of course, you WANTED that big ol' F on your birth certificate.
I wouldn't worry to much about it being legal or illegal. My birth certificate had my gender updated before my ID was updated. My ID was updated within a couple weeks of that. It took a letter from doctor to update the gender on the birth certificate. The same letter that I had needed to update Social Security.
Just get the court order done as soon as you can.
