Title: South Carolina Name change/Gender marker on ID
Post by: JulieC on January 16, 2015, 09:33:11 PM
Does anyone know how hard/easy the process is to legally change your name is South Carolina? Also how to change your gender marker on your ID? I know it's an old fashioned state and not very progressive so I wasn't sure how complicated the process was. I found some information online but wanted to check with anyone who has done the process here first hand for their experiences.
I still have a few months before I begin living full time as a woman and want to make sure I am ready when the time comes to change documents.

I can't tell you how to get that done in NC, but work with an attorney who will make all the changes legally. Make sure to get your name and gender changed on your birth certificate in case you need it some day. An attorney will also help you change the name and gender connected with you social security.

I have done a little research and found out that you have to have a court order to change name/gender.  If you want to change gender, you have to have a letter from your surgeon showing you had srs done. I wish they would change the law a little(I live in SC).  Oh, the dmv also has to have the same for changing your gender.

The link for changing your gender on your DL in SC seems to be dead.   Just letting you know.    :)

Change of Name

Similar to many states. Take a look at your jurisdiction's circuit court website and see if they have anything about name changes. They may have a form, or you may need a generic court order. Submit it to the local circuit court. You may need to be fingerprinted and get screened by law enforcement to make sure you're not trying to commit fraud via name change. You may have to attend a hearing. Judge decides. You pay some dollars. New name.

Change of Gender

Scroll to the bottom there past all the voting stuff. This will largely depend on which documents you want to update. You'll need a letter from a doctor saying that you've medically transitioned. I'd personally start with Social Security and a Passport, as these can get you around the use of the birth certificate. For your driver's license, you'll need to submit a court order to the DMV for a gender marker change. You'll need to provide medical documentation.
