Maryland man fights denial of visitation rights of child

"ANNAPOLIS, Md. (AP) — A Maryland man has asked the state's Court of Appeals to review a lower court's decision that denied him visitation and custody rights to a child."
The article has me confused a bit, kinda hard to follow.
"In August, the Court of Special Appeals held that Conover lacks parental standing noting the lack of state laws governing same-sex divorces."
They are denying his status as a male in a heterosexual marriage. There saying because it's a lesbian marriage . His rights are voided because the laws don't apply
Doesn't make sense. Maryland has had same sex marriage for years.

I think the issue is not the validity of the marriage, but rather the rights of a parent who is neither biologically related to nor has legally adopted the child.
