"A magistrate will be asked to consider that an assault victim is a 'six-foot-six, 120kg transgender person' when he sentences a man who attacked her during a night out at the pub.

Stephanie McCarthy suffered a fractured cheekbone and eye socket after being held down and repeatedly bashed by a gang of young men at the Town Hall Hotel - known as 'the Townie' - in inner west Sydney's Newtown on the early hours of June 6."

OMG what nonsense. A "gang of young men" > one person, no matter their physical size/weight.

In addition, it seems to me that ANY attack against someone who is not willing or able to fight back is still an attack, regardless of any other factors.
