We can't really know that without knowing where you live. Each state and country has it's own laws. That being said, if topless is allowed there for women, no. If you still look enough like a man, no one will comment, but in general, yes you do.

I don't see why you wouldn't if its a public swimming pool etc, but elsewhere it should be fine.

There shouldn't be any "loop hole" for MTF.

That said, in some places like NYC, women being topless is perfectly OK.

Your presentation will determine how people see you anyway. If you go in just a women's bikini bottom and no top, you might cause some stares. If you look female you will probably attract the wrong kind of attention. If you go in men's swimming trunks, maybe not.

If you have a hairy chest then going topless will probably not cause problems. Under the letter of the law though you may have issues but I don't see it being enforced.

Nobody swimming is asking for your ID anyway.

But I don't like this idea of a "loop hole" because that's what people who are against us say anyway that we don't know what it's like to be a woman because we still retain male privilege. For me it is a package deal. I take the good with the bad. It is who I am. I see no choice really.

A woman never flashes her top for no reason. If you are a woman at a public pool in the US, you should have a top on.
You are asking for trouble doing the opposite.

I was talking with my partner about this today. I'm nonbinary and am doing my pre-HRT research has had me thinking about what to expect. I feel a lot of conflict about this because growing up I felt uncomfortable taking my shirt off in public and once I let go of that anxiety I felt really free so I've really come to enjoy being topless, publicly and privately. I associate it with self-acceptance. Now I'm going to be faced with anxiety not because I'm ashamed of my body, but because others will tell me I should be. To me it feels like I'll be losing an element of self-love.

^^ Basically this. Unless being topless for women is legal where you're at....stick to that ^

Black beach. You can not only go topless but bottomless as well. They often have guards posted at the entrances and may not allow you to enter unless are appropriately unattired. Another hazard is airplanes and the Good Year blimp often make passes just off shore.

I believe it comes down to how you are seen and presenting and how your top looks too regardless of how you presented. Hugs

True, true.  If you're a woman and you want to go topless, go topless.  If you get arrested for that, fight for topfreedom.  Challenge it on the basis that "nude ain't lewd."  But... don't expect to be treated better than ciswomen.  Expect to be treated worse by cops, by jail guards, by judges and by fellow inmates.

Keep in mind that public indecency can get you pegged as a sex offender in some jurisdictions.

??? I'm really sorry I don't want to offend or hurt anybody but what happens with some people here? some posts or/and questions are unbelievable, I really doubt if those people are really so naive, want only to draw attention or if they really have psychological problems and see a totally twisted world!

Not everyone is conflicted by public nudity and I am grateful to live in a State where we have nude bicycle rides through Portland, nude beaches and progressive laws that recognize a right to self expression with or without clothing.  The Oregon Country Fair is a giant 3 day festival in the woods and many women spend the day there topless.  No one here speaks for all women about nudity.

No matter what you wear there is no reason to accept clothing or not as a perversion or to suggest it is "asking" for anything.

Being free and comfortable in your own skin is wonderful

I like the question. For me it is a matter of beeing a girl like many other girl. So I wear a top because most women wear tops. To be honest I think it is more sexy to cover something than to show ogg everything. So I like it, I feeld and look like all other girls and sometimes I ferl sexy. So why should I go swimming topless?
I am naked in the sauna. It is okay for me to be naked if everyone is naked. But I would not go topless when all other girls are wearing tops.
