Title: Birth certificate amendment
Post by: Sircaleb on January 05, 2017, 11:46:23 AM
Hi all, My name is Caleb and Ive been transitioning since 2004 but started the medical aspects in 2011. Im nearing the end of my journey and hope to be completed with my phalloplasty by the end of 2018. The last thing on my list was amending my birth certificate.  I submitted all required documents but it was denied because my name change decree did not have my birth surname on the decree. The state where I got my name change does not put your birth surname only your legal name at that time. My home state is demand that i have my name decree modified to include my birth surname but i contacted the court in that state and they will not modify or anend a name change decree so I literally can not amend my birth certificate has anyone come across this or know what i can do? I emailed every lawyer at #transhelp but none replied. Thanks in advance

Welcome to Susan's Place. I don't know the solution to the problem but you might ask if they will accept some alternate form of documentation. Another solution would be to contact a lawyer in your current state and see if their is a way to force your current state to produce some form of documentation that will be acceptable to your birth state.

We issue to all new members the following links so you will best be able to use the web site.

Hi Caleb, welcome to Susan's Place. You can  look up the  various regulations here.  (https://www.susans.org/wiki/Category:Documentation_changes)

You  should be able to provide the paper trail from birth name to out-of-state legal name to name change decree name and meet your home state demands. Good luck!
