A transgender woman in federal prison has filed a lawsuit against President Donald Trump over an executive order he signed on his first day back in office that rolls back protections for transgender people.
The order said the federal government would recognize only two sexes—male or female—and calls for housing transgender women in men's prisons, and halting gender-affirming medical care.
The complaint, filed on behalf of a plaintiff using the pseudonym Maria Moe, alleges the order violates Moe's constitutional and statutory rights and that if transferred to a men's facility, "she will be at an extremely high risk of harassment, abuse, violence, and sexual assault."
As well as Trump, the lawsuit... also lists acting attorney general James McHenry III and William Lothrop, the acting director of the Federal Bureau of Prisons, as defendants.
Moe, who has been diagnosed with gender dysphoria, has "lived as a woman and has taken hormones continuously since she was a teenager," the lawsuit says.
"She has always been housed in a women's facility while in federal custody," it says. Although her conviction is redacted, it adds that she "has no violent disciplinary history, poses no threat to her female peers, and her presence in the women's facility has not caused any disruption or interference with prison operations."
It feels like our government has declared war against us. There has to be some meaningful way we can prepare ourselves and fight back so they recognize that we are not rolling over without a fight. But I don't know what that meaningful action will be.

Amnesty International, the ACLU, the Human Rights Campaign, Lambda Legal, and other civil rights organizations have stated they have been planning court challenges for a year. < insert cricket sounds >
The last I read, Lambda Legal said it will take a couple of months. ??? But you have been planning for this for a year?
On the day that Joe Biden was inaugurated, Marjorie Taylor Green filed Articles of Impeachment on him for criminal conduct. He was never convicted, so the articles never moved forward. Now we have a twice impeached, convicted felon sworn in and ... <louder cricket sounds >. It is not that the articles will ever have any effect. To quote The Joker in The Dark Knight, "It's about sending a message."
Challenges are being filed at the State level. Most claim that they are waiting to see what action the federal agencies will take under the Executive Orders. Then their federal court challenges will attack those policies.
The agencies could refuse to do anything because illegal or unconstitutional orders cannot be enforced. That is not likely to happen, so they are waiting to see what exactly they will do and address that specifically. Courts want to know what damages these actions are causing, so until action is taken that causes damage, there really isn't a court case to file.
