Title: Tried to change my name....epic fail
Post by: DavisJ86 on April 13, 2010, 04:36:27 PM
So apparently, what I thought was my birth certificate, isn't my birth certificate, but some card given to my mom from the Maryland department of vital records. Which sucks cause today was name change day and it wasn't. So I just got to wait until my actual birth certificate gets here.

My fail boat seriously sunk today.

You need a birth cert to change your name?  That seems strange. They just sent info to vital records and changed it and then offered to sell me a new copy.

Maryland rules say proof of current name not necessarily a birth cert. a driver license passport or other documents are acceptable.

Who is "they"?

Sorry, Davis. You usually need a certified copy of the birth certificate to carry out transactions like this one.

Okay, thanks. So your court didn't need a birth certificate. Some courts do stipulate that they prefer a birth cert, but they actually don't require it.

But some clerks insist on one thing when something else will do. I encountered a gal like that when I went to get married, and I had to do some fancy arguing to talk her out of her misguided perceptions.

Davis, did you try showing your driver's license (if you have one) or some other official proof of your birth name? There might have been a misunderstanding here.

ye, In WI, you don't have to prove your old name at all. They never even ask, you just fill out the forms and do the notice.

LoL...thanks guys for the info, but to explain things better, I live in MA so I need the certified birth certificate from Maryland because I was born there. So that's why I need the birth certificate

Definitely major suckage, but oh well I'll just wait it out. That's the one thing I realized with transition. Everything is a rush to get done, but once you get to a point, it's waiting for someone else to get things done.

I never thought of it that way. I quite like that.

As I stated Davis, you don't need the birth cert, you need proof of your current name.

Where are you getting this info? The MA gov't court site says that a certified birth cert is needed.

For a person over 7 years of age, two or more of the following documents citing the correct name need to be submitted:

    * Baptismal or other church records;
    * Insurance policy;
    * Hospital or clinic record;
    * Physician's office record of birth;
    * Pre-kindergarten record or grade-school record;
    * Family bible record;
    * Record of employment;
    * Record of military service;
    * Marriage license;
    * Record from federal census;
    * Birth certificate of a child of the subject of the vital record;
    * Social Security Administration record of the subject of the vital record's original application for a Social Security Number;
    * Other pertinent records which meet the Secretary's approval and corroborate the name of the vital record.

LordKat, those are rules for Maryland, not Massachusetts. And they're for changing a birth certificate, not a court-ordered name change.

Maybe you were drinking the same stuff I was drinking last night. >:-)

The reasoning for looking under Maryland
    *

      Step 3. Attach Proof of Current Name and File the Petition.

You must attach proof of your current name. A certified copy of a birth certificate is preferred but you can also use other documents like a passport or driver's license that prove your current name.

Next, you file the petition and attachment with the civil clerk's office at your local courthouse. Here is a Directory of Courthouses in Maryland. You will find directions and hours for each courthouse in the state.

Cost – The fee for this is $105. There is a fee waiver if you cannot afford to pay the fee. Form DR# 32. If a judge approves the waiver, you will not have to pay the fee.

from the part on what steps to take to change your name, not Birth cert.

Ok so since he hasn't said it again yet, LordKat, we live in Mass, he is changing his name in Mass, the ONLY thing from Maryland is his Birth Certificate because he was born there...hope that helps..
