The issue of what constitutes a 'woman' or a 'man' has been going on for some time.  To some, the definition is based upon genetic sex, and to others, it is the gender characteristics that a person has from birth.  In Texas, it is illegal for a woman to marry a woman or a man to marry a man, but it is not illegal for a person who has undergone a sex change operation to marry a person of the opposite sex.

How about legalize marriage for same-sex couples and for all transpeople?
There, problem solved! No more confusion!

According to the Texas Family Code, there are 19 different documents that are accepted as identification for the purpose of marriage. They are listed here in the code, Chapter 2, subchapter A, section 2.005(b):

http://www.statutes.legis.state.tx.us/Docs/FA/htm/FA.2.htm#2.005 (http://www.statutes.legis.state.tx.us/Docs/FA/htm/FA.2.htm#2.005)

I was born in Dallas and will have to hire a lawyer to get my birth certificate changed as it requires a court order there for a BC gender change, just the surgeon's letter is not enough. This isn't a high priority for me because of the expense, and my U.S. passport says "F" on it anyway which is good for ID anywhere. What I think this means though is that according to the Family Code, I could marry either a man or a woman depending on which ID document I present at the time I apply for my marriage license lol

Red Dwarf Moment: ;D
If you are in a same-sex marriage somewhere like Canada, would you commit Bigamy if you then marry someone of the opposite sex ,in Texas, without divorcing your first spouse?
