Title: name change and discharged bankruptcy in Florida

Ok I had a discharged Bankruptcy in Florida back in 2006 and would like to change my first and last name in Florida and I would like to do it myself has anyone had any experience doing this in Florida.

Mindy, I have no experience myself but as long as the bankruptcy has been taken care of and isn't in the process of I don't believe you will have any issues especially considering how long it has been? Also you might try asking around at the courthouse for a solid answer if no one here can help.

Just a side not this is the ftm section and it seems like that isn't where you wanted this to go...

I do know the forms ask if you have file bankruptcy. I think a lot of those questions are to make certain that you are not trying to escape previous bankruptcies, convictions, child support etc. by "disappearing" via name change. I don't think they will necessarily keep you from changing your names.

I'm hoping (with no real basis to guess) that so long as you can declare and acknowledge any pending debt or obligation (as Melody said, to avoid the accusation of fraud)  that things like this will not impede a name change.

He is allowed to post in the MTF section  :P - There are private MTF and FTM forums if we want to keep them out.

I have not filed bankruptcy, but I am in the process of getting my name changed here in Orlando, Fl. All of the preliminary paperwork goes by painlessly. Now I have to go in for my court date this Wednesday and get the final judgment. The others are right, bankruptcy shouldn't keep you from getting your name changed.

Hi Mindy, glad to hear of your name change.   ;D While I do not have experience in FL can offer some general advice on this going pro se.
1. ask 5-10 attorneys by phone cost of doing the process, judges/courts are picky about accuracy and many forms and so on and can thought out your name change based on your reasons or errors.

2. By discharged, you mean the chapter 7/13 process completed and approved by trustte then bankrutcy court. While the state you live in determines your exemptions, bankruptcy court is a federal court. So I am guessing your are ~4 years out from complete filing and either on CH 13 repayment or CH 7 debt discharge. In any case as your start the process of name change, send your trusstee a letter of your intention to change your name, that you will notify her/him of completion and then ask what they need to be sure. The attempt of fraud is a big red flag for them so tletting them know up front is a good thing.

3. You need to go get current fingerprints, usually the local sherrifs or state police office, depends.

4. Link below to FL Supreme Court forms and instructions for name change. Print pages you need. BUT call your county circuit court and ask, 'Is this where I file for change of name? " Can I stop by and get the most current forms.... most people assume there is consistency between courts in a county, state, nation. Whiles citizens and lawyers have to adhere to letter of law, the courts may vary on judicial decision, forms, rules.. this is true of federal courts too.  more follows

4... so get local court advice. If you did not do bankruptcy pro se, at least ask that attorney for help for minimal fee. Here are the rules, instructions and forms for FL, but go in person to county circuit court and ask.

5. Once your name change is approved in your county circuit court. (Note that bankruptcy filing is required part of form.) 6. Once get SSN in new name can and MUST notify your bankruptcy court, trusstee and likely they have a form or two. This court needs to know who and where your are. Just keeps everyone involved in the loop, a must.

so local circuit court, Social Security Admin., then bankruptcy court.

Legal name change is actually the easy part. Changing my name on EVERYTHING after this was a nightmare! But finally now I even get junk mail in my new name so it's all done lol
