Via NBC Chicago's Jail Has New Policy for Transgender Inmates; Gender-identification, rather than sex at birth, respected under new policy:
Transgender inmates at Cook County Jail can now be housed, dressed and searched according to the gender they identify with rather than their sex at birth under a new policy that advocates hope will keep some of the facility's most vulnerable detainees safe.

Does this apply to all or just post op?
I have a good friend who is in prison. She's pre-op MtF and they have her in with the men (very sad & scary) she says they go by what genitals you have.
Many many years ago I did a number of years in prison. Luckily for me at the time I was deeply closeted. I saw how preop transwomen were incarcerated with the men. These women survived by having a jail husband or prostitution.
It is bad enough doing time in a prison. Being a woman in a mans facility is double the punishment. Rape and forced prostitution should not be part of anyones incarceration.
