The Supreme Court on Tuesday appeared inclined to uphold state laws banning transgender women and girls from competing in female sports events.
Justices in the court's conservative majority voiced skepticism that such laws unconstitutionally discriminate against transgender athletes. They said that strictly segregating school sports based on biological sex protects the rights of women and girls.
"There are an awful lot of female athletes who are strongly opposed to participation by trans athletes and competitions with them," Justice Samuel Alito said. "Are they bigots? Are they deluded in thinking that they are subjected to unfair competition?"
The court heard more than three hours of oral arguments in back-to-back cases challenging laws in Idaho and West Virginia. They are two of 27 states that limit participation in girls' sports to athletes whose sex was recorded as female at birth.
Justice Brett Kavanaugh highlighted the lack of consensus among states on the issue, as well as the continuing scientific dispute about whether transgender women athletes with medically induced lower testosterone levels have competitive advantages in women's sports.
"Half the states are allowing transgender girls and women to participate, about half are not," he said. "Why would we, at this point, jump in and try to constitutionalize a rule for the whole country?"
Kavanaugh, who coaches girls' basketball, brought a personal perspective to the issue. "For the individual girl who does not make the team or doesn't get on the stand for the medal or doesn't make all-league, there's a harm there," he said. "And I think we can't sweep that aside."============================================================================================
I think the final quote from Kavanaugh provides a clue. He doesn't see trans girls as girls, or trans women as women. Also note that there is no mention of trans boys or trans men.
