Transgender people in Kansas have been told to surrender their driver's licenses or face steep penalties and misdemeanor charges.
According to Erin in the Morning, trans residents of the state whose gender markers on their licenses reflect their gender identity and not the sex they were assigned at birth began receiving letters from the Kansas Division of Vehicles this week informing them that upon the publication of S.B. 244 in the Kansas Register on Thursday, February 26, their current licenses would be invalidated.
Among other anti-trans provisions that Republican lawmakers snuck into an unrelated bill in January, S.B. 244 requires Kansas driver's licenses and birth certificates to indicate a person's sex assigned at birth regardless of their gender identity.
The letter, dated February 23, notes that the state Legislature did not include a grace period for updating credentials in the law.
"This means that once the law is officially enacted, your current credential will be invalid immediately and you may be subject to additional penalties if you are operating a vehicle without a valid credential," a copy of the letter published by Erin in the Morning reads.
The notice leaves trans residents to figure out for themselves how to even get to the DMV to surrender their licenses without risking class B misdemeanor charges, a $1,000 fine, and a 90-day license suspension. As Erin in the Morning notes, a class B misdemeanor charge is punishable by up to six months in jail in Kansas, where counties are required to house inmates according to sex assigned at birth.
