One problem with this is that no one walks into a government office and has their identity documents changed without supporting documentation, e.g., a letter from a doctor, a court order, etc.
Perhaps the state of Indiana (and others) should be prosecuting the judges who issued those orders. It is not fraud if you are following a court order. It is not fraud if you are updating your identity document based on a medical finding.
The people getting hurt in all of this are not the doctors, lawyers, judges, government officials, or politicians. It is the people who are trying to follow the law and ensure that the correct information is displayed on their identity documents to help positively identify them. That is the purpose of an identity document.
