There's a renewed push in Lansing to remove Michigan's same-sex marriage ban from the state constitution—even though it's been unenforceable for more than a decade.
"We are here to discuss the future of the marriage ban language in our state Constitution that has existed for 22 years," Sen. Jeremy Moss (D–Southfield) said.
Voters approved it to the state's constitution in 2004 defining a marriage as between a man and woman.
"It took everything off the table for LGBT couples. No right to marry, no civil unions, no domestic partner benefits." ACLU Michigan Staff Attorney Jay Kaplan said.
"The United States Supreme Court has held that it's a violation of the 14th amendment to the US Constitution," University of Michigan Law Professor Sam Bergenstor said.
"We can safely assume that in the next several years, a case challenging marriage equality will make it to the United States Supreme Court and Michigan needs to be prepared for this possibility," Kaplan said.
"We are now living in a time that we feel that this could all be taken away from us," DeBoer v. Snyder Plaintiff April DeBoer said. "That we could be legal strangers to each other, we could be legal strangers to our kids."---------------------------------
