A transgender activist in Kansas broke the state's new anti-trans bathroom access law in an act of civil disobedience this week, earning her an apology from Gov. Laura Kelly.
Activist Samantha Boucher intentionally used a women's bathroom multiple times in the Kansas State Capitol building on Tuesday, protesting SB 244, a state law pushed through by Republicans in February which bans trans people from using bathrooms in government buildings that match their gender identity. Before her action, Boucher approached Kelly while she was speaking with members of the press, NBC affiliate KSNT reported.
"In regard to SB 244, I will use the restroom 3 times, triggering a misdemeanor. I appreciate your veto," Boucher reportedly told Kelly, who vetoed the bill in February but was overridden by the state's Republican supermajority.
"I am very sorry that you and others are being put in this situation," Kelly replied. Boucher walked away and shouted "And now, we will see if the attorney general chooses to enforce the law," per ABC affiliate KAKE.
Boucher then reportedly used a women's bathroom on the building's second floor, which was witnessed by Capitol Police officers. Police took Boucher to a private room, and later told KSNT that they were investigating the situation but would not take legal action "at this time." Two violations of SB 244 may result in a $1,000 civil fine, according to the law's text, while a third may be charged as a class B misdemeanor.
