After months of rumors that the Trump administration was considering making it harder for trans people to buy guns, the Department of Justice officially released a proposed rule on Tuesday that would do exactly that.

The rule suggests that applicants for firearms-related forms should be required to select their biological sex, which it makes clear "means an individual's immutable biological classification as either male or female" and is "not a synonym for and does not include the concept of gender identity."

The proposal cites the president's executive order, Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government. Signed on January 20, 2025, the order declared that trans identities would not be legally recognized and that there were only two immutable sexes, male and female.

The document says the rule has been proposed to be "consistent" with the order and will "resolve any potential confusion on how to fill out ATF forms."

"The rule would make clear that ATF seeks biological sex, consistent with the ordinary meaning of the regulatory language," it stated.

Public comments are open until August 4, 2026.

The proposal also suggests that  U.S. Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) forms "shall be executed under penalties of perjury," meaning folks who are caught "lying" about their sex could be convicted of a felony and face up to five years in prison.
