A Kansas judge has issued an order to temporarily reinstate the driver's license of one trans woman. The ruling states that she is likely to succeed in her case against the Kansas Department of Revenue (KDOR) and that KDOR violated due process by invalidating the license.

In February, trans people who had updated the gender marker on their licenses began receiving letters telling them that their license would be invalidated on February 26, with some letters arriving after that date.

Jamie Miller received such a letter, but originally believed that it didn't apply to her as she had received complete gender reassignment surgery in 2013 and had a court order legally identifying her as a woman. She told the Lawrence Times, "That was my understanding, according to the law at the time, that that was what I needed to do to establish my identity."

However, when she received a letter confirming that her license was being revoked, she called KDOR, which issues the state's licenses, and was told to email a copy of her court order to appeal the decision. She then received a form response and never heard from KDOR again.

Miller, a military veteran, filed a lawsuit against the state with her lawyer pointing out that the state was putting her in a catch-22: the court order stated that she was female in the eyes of the law while SB 244 redefined her as male.

That is such a nightmare and one I hope to avoid.

I have a letter, a sworn statement, from a VA doctor stating that I have completed the necessary clinical treatments to change my gender from male to female.

I used that letter in court as the justification to legally change my name. The court found it sufficient evidence and ordered that I could change my birth certificate.

Those two pieces of evidence were sent to another state to correct my birth certificate.

That birth certificate was used to support my passport and driver's license applications.

So I have a federal employee, a court, and two different state agencies (DMV and Birth Registry) in two different states, and the U.S. State Department all confirming my name and gender. That's not to mention Veteran Medical records and disability pension, Social Security, credit reports, and banking records.

If any state agency or law arbitrarily decides it doesn't support that, it is not my records that are wrong.
